Terms of Service

1. Introduction

These Terms of Service ("Terms") govern your use of the Nearva mobile application and website (together, the "Service"), operated by PM Consulting, Kleiputstraat 6, 2360 Oud-Turnhout, Belgium. VAT BE0647814401.

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Definitions

• "Service" - the Nearva mobile application, web application, and website at nearva.eu.
• "User" - any person who accesses or uses the Service.
• "Content" - any text, images, reviews, trips, profile information, or other material submitted by Users.
• "Premium Subscription" - a paid subscription that unlocks additional features such as offline maps, ad-free experience, advanced filters, weather-aware day planner, and trip planning.

3. Account Registration

To access certain features, you must create an account. You agree to:

• Be at least 16 years of age.
• Provide accurate and complete registration information.
• Keep your password confidential and be responsible for all activity under your account.
• Notify us immediately of any unauthorized use of your account.

4. Use of the Service

You may use the Service for personal, non-commercial purposes in accordance with these Terms. You agree not to:

• Scrape, crawl, or use automated means to access or collect data from the Service.
• Reverse engineer, decompile, or disassemble any part of the Service.
• Use the Service to harass, abuse, or harm others.
• Post false, misleading, or fraudulent reviews.
• Send spam or unsolicited communications through the Service.
• Interfere with or disrupt the Service or servers connected to it.
• Circumvent any access controls or usage limits.

5. User-Generated Content

You may submit Content to the Service, including reviews, trips, and profile information. By submitting Content, you:

• Retain ownership of your Content.
• Grant Nearva a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute your Content in connection with the Service.
• Represent that your Content does not violate the rights of any third party.

Nearva reserves the right to moderate, edit, or remove any Content at its sole discretion, without notice. Nearva has no obligation to host, store, or make available any Content.

6. Premium Subscriptions & Payments

Premium Subscriptions are billed through the Google Play Store. By purchasing a Premium Subscription, you agree to the following:

• Subscriptions auto-renew at the end of each billing period unless cancelled.
• You can cancel your subscription at any time through the Google Play Store. Cancellation takes effect at the end of the current billing period.
• Refunds are handled in accordance with the Google Play refund policy.
• Nearva may change subscription prices with at least 30 days' notice. Continued use after the price change constitutes acceptance.

7. Intellectual Property

The Service, including its design, branding, software, and all non-user content, is owned by PM Consulting and protected by copyright, trademark, and other intellectual property laws.

Location data is aggregated from third-party sources (including OpenStreetMap, park4night, and others) and is attributed accordingly. You may not reproduce, redistribute, or commercially exploit the data available through the Service.

8. Third-Party Services

The Service integrates with third-party services including, but not limited to:

• OpenStreetMap (map data and tiles)
• OpenWeatherMap (weather data)
• Google Places (location enrichment)
• Tankerkoenig (fuel prices)
• Waymarked Trails (hiking trail data)
• OpenRouteService (routing and directions)

Your use of data from these services is subject to their respective terms of service and licenses. Nearva is not responsible for the accuracy, availability, or content provided by third-party services.

9. Privacy & Data Protection

Your privacy is important to us. Please refer to our Privacy Policy for detailed information about how we collect, use, and protect your personal data.

We process personal data on the following lawful bases under the GDPR:

• Contract - to provide the Service and manage your account.
• Consent - for optional features such as location tracking and marketing communications.
• Legitimate interest - for analytics, fraud prevention, and service improvement.

You have the following rights under the GDPR:

• Right to access your personal data.
• Right to rectify inaccurate data.
• Right to erase your data ("right to be forgotten").
• Right to data portability.
• Right to restrict processing.
• Right to object to processing.
• Right to lodge a complaint with the Belgian Data Protection Authority (Gegevensbeschermingsautoriteit).

All personal data is processed within the European Union.

10. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. In particular:

• We do not guarantee the accuracy of location data, fuel prices, weather forecasts, trail information, or any other data displayed in the Service.
• We are not responsible for decisions you make based on information provided through the Service.
• We do not guarantee uninterrupted or error-free access to the Service.

11. Limitation of Liability

To the maximum extent permitted by applicable law:

• Nearva's total liability to you for any claims arising from your use of the Service is limited to the amount you have paid for Premium Subscriptions in the 12 months preceding the claim.
• Nearva shall not be liable for any indirect, incidental, special, consequential, or punitive damages.

12. Termination

• You may delete your account at any time through the app settings.
• Nearva may suspend or terminate your account at any time if you violate these Terms.
• Upon termination, your right to use the Service ceases immediately.
• You may request deletion of your personal data in accordance with the GDPR. We will process such requests within 30 days.

13. Changes to Terms

We may update these Terms from time to time. For material changes, we will provide at least 30 days' notice through the Service or via email. Your continued use of the Service after the effective date of any changes constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of Belgium. Any disputes arising from or in connection with these Terms shall be submitted to the exclusive jurisdiction of the courts of Turnhout, Belgium.

Algemene Voorwaarden

1. Inleiding

Deze Algemene Voorwaarden ("Voorwaarden") regelen het gebruik van de Nearva mobiele applicatie en website (samen de "Dienst"), beheerd door PM Consulting, Kleiputstraat 6, 2360 Oud-Turnhout, België. BTW BE0647814401.

Door een account aan te maken of de Dienst te gebruiken, gaat u akkoord met deze Voorwaarden. Als u niet akkoord gaat, gebruik de Dienst dan niet.

2. Definities

• "Dienst" - de Nearva mobiele applicatie, webapplicatie en website op nearva.eu.
• "Gebruiker" - elke persoon die de Dienst opent of gebruikt.
• "Content" - alle tekst, afbeeldingen, reviews, reizen, profielinformatie of ander materiaal dat door Gebruikers wordt ingediend.
• "Premium-abonnement" - een betaald abonnement dat extra functies ontgrendelt zoals offline kaarten, advertentievrije ervaring, geavanceerde filters, weerslimme dagplanner en reisplanning.

3. Accountregistratie

Om bepaalde functies te gebruiken, moet u een account aanmaken. U stemt ermee in om:

• Minimaal 16 jaar oud te zijn.
• Nauwkeurige en volledige registratie-informatie te verstrekken.
• Uw wachtwoord vertrouwelijk te houden en verantwoordelijk te zijn voor alle activiteit onder uw account.
• Ons onmiddellijk op de hoogte te stellen van ongeautoriseerd gebruik van uw account.

4. Gebruik van de Dienst

U mag de Dienst gebruiken voor persoonlijke, niet-commerciële doeleinden in overeenstemming met deze Voorwaarden. U stemt ermee in om niet:

• Gegevens van de Dienst te scrapen, crawlen of via geautomatiseerde middelen te verzamelen.
• Enig deel van de Dienst te reverse-engineeren, decompileren of disassembleren.
• De Dienst te gebruiken om anderen te pesten, misbruiken of schade toe te brengen.
• Valse, misleidende of frauduleuze reviews te plaatsen.
• Spam of ongevraagde berichten via de Dienst te versturen.
• De Dienst of verbonden servers te verstoren of te onderbreken.
• Toegangscontroles of gebruikslimieten te omzeilen.

5. Door gebruikers gegenereerde content

U kunt Content indienen bij de Dienst, waaronder reviews, reizen en profielinformatie. Door Content in te dienen:

• Behoudt u het eigendom van uw Content.
• Verleent u Nearva een niet-exclusieve, wereldwijde, royaltyvrije licentie om uw Content te gebruiken, weer te geven, te reproduceren en te verspreiden in verband met de Dienst.
• Verklaart u dat uw Content geen inbreuk maakt op de rechten van derden.

Nearva behoudt zich het recht voor om Content naar eigen goeddunken te modereren, bewerken of verwijderen, zonder kennisgeving. Nearva heeft geen verplichting om Content te hosten, op te slaan of beschikbaar te stellen.

6. Premium-abonnementen & betalingen

Premium-abonnementen worden gefactureerd via de Google Play Store. Door een Premium-abonnement aan te schaffen, gaat u akkoord met het volgende:

• Abonnementen worden automatisch verlengd aan het einde van elke factureringsperiode, tenzij opgezegd.
• U kunt uw abonnement op elk moment opzeggen via de Google Play Store. Opzegging gaat in aan het einde van de lopende factureringsperiode.
• Restituties worden afgehandeld conform het restitutiebeleid van Google Play.
• Nearva mag abonnementsprijzen wijzigen met minimaal 30 dagen voorafgaande kennisgeving. Voortgezet gebruik na de prijswijziging geldt als aanvaarding.

7. Intellectueel eigendom

De Dienst, inclusief het ontwerp, de branding, de software en alle niet-gebruikerscontent, is eigendom van PM Consulting en wordt beschermd door auteursrecht, merkenrecht en andere intellectuele-eigendomswetten.

Locatiegegevens worden samengevoegd uit externe bronnen (waaronder OpenStreetMap, park4night en anderen) en worden dienovereenkomstig toegeschreven. U mag de via de Dienst beschikbare gegevens niet reproduceren, herdistribueren of commercieel exploiteren.

8. Diensten van derden

De Dienst integreert met diensten van derden, waaronder maar niet beperkt tot:

• OpenStreetMap (kaartgegevens en tegels)
• OpenWeatherMap (weergegevens)
• Google Places (locatieverrijking)
• Tankerkoenig (brandstofprijzen)
• Waymarked Trails (wandelroutegegevens)
• OpenRouteService (routering en routebeschrijvingen)

Uw gebruik van gegevens van deze diensten is onderworpen aan hun respectieve gebruiksvoorwaarden en licenties. Nearva is niet verantwoordelijk voor de nauwkeurigheid, beschikbaarheid of content van diensten van derden.

9. Privacy & gegevensbescherming

Uw privacy is belangrijk voor ons. Raadpleeg ons Privacybeleid voor gedetailleerde informatie over hoe wij uw persoonsgegevens verzamelen, gebruiken en beschermen.

Wij verwerken persoonsgegevens op de volgende rechtmatige grondslagen onder de AVG:

• Overeenkomst - om de Dienst te leveren en uw account te beheren.
• Toestemming - voor optionele functies zoals locatietracking en marketingcommunicatie.
• Gerechtvaardigd belang - voor analyse, fraudepreventie en dienstverbetering.

U heeft de volgende rechten onder de AVG:

• Recht op inzage van uw persoonsgegevens.
• Recht op rectificatie van onjuiste gegevens.
• Recht op wissing van uw gegevens ("recht om vergeten te worden").
• Recht op gegevensoverdraagbaarheid.
• Recht op beperking van de verwerking.
• Recht op bezwaar tegen verwerking.
• Recht om een klacht in te dienen bij de Belgische Gegevensbeschermingsautoriteit.

Alle persoonsgegevens worden verwerkt binnen de Europese Unie.

10. Disclaimers

De Dienst wordt geleverd "zoals het is" en "zoals beschikbaar" zonder enige garantie, uitdrukkelijk of impliciet. In het bijzonder:

• Wij garanderen niet de nauwkeurigheid van locatiegegevens, brandstofprijzen, weersvoorspellingen, route-informatie of andere gegevens die in de Dienst worden weergegeven.
• Wij zijn niet verantwoordelijk voor beslissingen die u neemt op basis van informatie verstrekt via de Dienst.
• Wij garanderen geen ononderbroken of foutloze toegang tot de Dienst.

11. Beperking van aansprakelijkheid

Voor zover maximaal toegestaan door toepasselijk recht:

• De totale aansprakelijkheid van Nearva jegens u voor eventuele claims voortvloeiend uit uw gebruik van de Dienst is beperkt tot het bedrag dat u heeft betaald voor Premium-abonnementen in de 12 maanden voorafgaand aan de claim.
• Nearva is niet aansprakelijk voor enige indirecte, incidentele, bijzondere, gevolg- of punitieve schade.

12. Beëindiging

• U kunt uw account op elk moment verwijderen via de app-instellingen.
• Nearva mag uw account op elk moment opschorten of beëindigen als u deze Voorwaarden schendt.
• Bij beëindiging vervalt uw recht om de Dienst te gebruiken onmiddellijk.
• U kunt verzoeken om verwijdering van uw persoonsgegevens conform de AVG. Wij verwerken dergelijke verzoeken binnen 30 dagen.

13. Wijzigingen in de Voorwaarden

Wij kunnen deze Voorwaarden van tijd tot tijd bijwerken. Bij wezenlijke wijzigingen geven wij minimaal 30 dagen van tevoren kennisgeving via de Dienst of per e-mail. Uw voortgezet gebruik van de Dienst na de ingangsdatum van eventuele wijzigingen geldt als aanvaarding van de bijgewerkte Voorwaarden.

14. Toepasselijk recht

Deze Voorwaarden worden beheerst door en uitgelegd in overeenstemming met het Belgisch recht. Geschillen die voortvloeien uit of verband houden met deze Voorwaarden worden voorgelegd aan de exclusieve bevoegdheid van de rechtbanken van Turnhout, België.
